These terms apply to work quoted and carried out by Drapehaus. Where your written quote says something different, the quote takes precedence.
Quotes are given in writing and set out the specific fabric, lining, heading, track and fittings being priced, together with the period for which the quote remains open. A quote is an offer to carry out that specification; changing the specification changes the price.
We do not quote from photographs. Any figure discussed before a site visit is an indication only and is not binding on either of us.
We measure on site and take responsibility for those measurements. Windows in Goan buildings are frequently out of square and floor levels vary, both of which affect what is cut.
Where you ask us to work from measurements you have supplied, we will make to those figures and cannot accept responsibility if the finished item does not fit.
We are usually happy to work with fabric you provide. We will advise you beforehand if we think it is unsuitable for where it is going, but we cannot guarantee its performance, colourfastness or durability, and we cannot replace it if it fails.
We will confirm the quantity required before cutting. Where supplied material proves insufficient, any delay or additional cost in obtaining more falls outside our control.
Work begins once you have approved the written specification. Items made to your measurements are cut for your windows and cannot reasonably be resold or reused elsewhere.
Because of this, there is a point after which a made-to-measure order cannot be cancelled without cost. Your quote states when that point falls for your order. Before it, changes and cancellation are straightforward; after it, materials have been committed and cutting may have begun. If you are unsure whether you want to proceed, tell us and we will hold the order rather than start it.
This does not affect any rights you have under applicable consumer law in respect of goods that are faulty or not as described.
Payment terms, including any deposit, are set out in your written quote and agreed before work begins. We will not vary them without telling you first.
We give you a date in the quote and will tell you promptly if anything is likely to move it. Dates depend on material availability and on site access, and occasionally on weather — during the monsoon, installation may need to be rescheduled.
Installation assumes reasonable access to the rooms concerned and a structurally sound surface to fix to. Where a wall turns out not to be sound, we will stop and discuss it with you rather than proceed with a fixing we do not trust.
Hardware we have supplied and installed is covered for one year from installation against faults and against damage that is not deliberate — for example brackets working loose, a mechanism binding, or a track needing realignment. We will return and put it right at no charge.
That cover does not extend to:
Where we have advised against a particular specification in writing and you have asked us to proceed anyway, we cannot be responsible for the consequences we identified.
We provide care guidance for what we supply. Following it matters more in this climate than in most — particularly airing fabric during the monsoon and taking curtains down in properties that close for the season.
We take responsibility for our own work and for damage we cause. We are not responsible for pre-existing defects in a building, or for losses that could not reasonably have been foreseen when the work was agreed.
Nothing in these terms limits liability where it cannot lawfully be limited.
If something is not right, tell us. We would far rather come back and fix it than have you live with it. Contact us at [email protected].
These terms are governed by the laws of India, and any dispute falls to the courts of Goa.
